Delivery driver stopped for cellphone use found to be prohibited from working, driving

A driver spotted holding a cellphone while delivering packages got more than a fine when he gave a false name to the Oak Bay police officer who stopped him.

After the 36-year-old’s real identity was determined, he was found to be inadmissible to Canada, prohibited from driving and working, with a work visa that expired two years ago.

The officer was exiting the police station parking lot on Monterey Avenue just before 3 p.m. on Sept. 5 when he saw the man doing deliveries in a cube van.

He was arrested for obstructing a police officer by providing a false name, and also faces a charge of driving while prohibited and a count under Section 55 of the Immigration Act.

Use of the cellphone while driving led to a $468 ticket and impoundment of the van.

After the man was transported to Saanich police cells, the Canadian Border Services Agency took over the investigation.
