Man arrested for disturbance in Oak Bay found with knife, axe

The man was on probation with conditions prohibiting him from possessing knives or axes

Oak Bay police arrested the man at 2:30 a.m. on Oct. 1 near the 2000-block of Cadboro Bay Road for causing a disturbance and refusing to identify himself.

Oak Bay police responded to calls about someone yelling profanities on a street corner in the early-morning hours, and found the man had an axe and a knife — even though he was not allowed to possess either one.

The man was arrested at 2:30 a.m. on Oct. 1 near the 2000-block of Cadboro Bay Road for causing a disturbance and refusing to identify himself.

Police said the loud screaming had gone on for about 15 minutes.

Police found the axe and knife in the man’s possession after a search.

The man was later identified as Justin Eby, 42, who was on probation with conditions prohibiting him from possessing knives or axes.

Eby was charged with causing a disturbance, two counts of possessing weapons dangerous to the public, failure to comply with probation conditions and obstructing a police officer.

He was held for a bail hearing and released by the court with several conditions. He is scheduled to make a court appearance on Oct. 17.
