Nanaimo and former CAO reach settlement in wrongful-dismissal case

The City of Nanaimo has reached an out-of-court settlement in a wrongful-dismissal suit filed by a former chief administrative officer.

The settlement with Tracy Samra, which is covered by a confidentiality agreement, also covers former mayor Bill McKay and current Coun. Sheryl Armstrong, who were named in the dispute.

Samra filed a lawsuit against the city in May 2021 in the Supreme Court of B.C. in Vancouver.

On Nov. 7, a consent order to dismiss the proceeding was approved in Supreme Court. The matter was wrapped up without costs to either party.

No details were provided in the court document.

Samra was terminated from the CAO position in May 2018.

She had joined the city in the winter of 2015 as its interim chief administration officer. The following March, she was offered the position and signed a four-year contract with the city.

In her claim, Samra said she lost the $180,000-a-year job without cause and without the required 12 months’ notice. She said she was bullied and harassed and the subject of false allegations.

In response, the city denied several allegations in Samra’s claim and said it did not breach the employment agreement with Samra or wrongfully dismiss her.

Samra is now known as Tracy Fleck. Her LinkedIn profile says she is director general for Indigenous affairs in the Department of National Defence.
